Terms and Conditions for Account Creation

TERMS OF USE AND PRIVACY POLICY. By accessing and using the GE Appliances’ Account website (which includes the SmartOrder subscription program) you agree to be bound by these Terms and Conditions for Account Creation, GE Appliances’ Terms of Use (“TOU”) and Privacy Policy/Mobile Privacy Policy which may be updated by GE Appliances from time to time without notice to you. Age & Responsibility

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. GE sells to adults, who can purchase with a credit card or other permitted payment method. If you are under 18, you may use the services in your account only with involvement of a parent or guardian.

For Smartorder Subscription Program

  1. ACCEPTANCE OF TERMS. Welcome to GE Appliances’ SmartOrder program (“SmartOrder”). SmartOrder is owned and operated by GE Appliances (“GEA”). The following terms and conditions (“Terms”) constitute the entire agreement between you and GE appliance related to SmartOrder and govern our respective rights and obligations.

  2. DESCRIPTION OF SMARTORDER. SmartOrder delivers replacement renewable GEA appliance parts automatically at the timeframe you choose.

    GE Appliances reserves the right in its sole and absolute discretion to revise the SmartOrder benefits including, but not limited to, pricing, discount amounts and eligibility criteria. Any such revisions by GE Appliances shall apply to future orders regardless of whether you currently are a SmartOrder subscriber.

  3. SMARTORDER PRODUCTS. Water filters, trash compactor bags, appliance cleaners and other GEA appliance renewable parts are eligible for SmartOrder. Only those products indicated are eligible and SmartOrder is limited to addresses located in the United States, excluding Puerto Rico. Shipments will not be made to P.O. boxes.

  4. PAYMENT. The only payment method accepted for SmartOrder is valid credit cards. Debit cards are not eligible for SmartOrder. Each SmartOrder item shipment will be charged to the credit card used to create your subscription. In the event we are unable to process your SmartOrder order with the credit card used to create your subscription, we will not ship your order until updated credit card information is provided to GE Appliances by logging into your account on-line or calling 800-626-2064 and speaking to a GE Appliances representative.

  5. RETURNS. SmartOrder products must be in sellable condition and comply with the following return policies to be returned for credit:

    • 30 Day Return Policy — Items returned within 30 days from the date shipped from our warehouse will not incur a restocking fee.
    • 31–90 Day Return Policy — Items returned within 31–90 days from the date shipped from our warehouse will incur a $15.00 restocking fee.
    • Over 90 Day Return Policy — GE Appliances will not accept returns on items over 90 days from the date shipped from our warehouse.

    If GE Appliances, in its sole discretion, determines your SmartOrder product return is due to our mistake or error, you will be given an additional $5.00 credit to cover shipping costs and a 10% discount code for the purchase of the correct SmartOrder product.

  6. YOUR OBLIGATIONS. As a SmartOrder subscriber, you represent that you are of legal age to form a binding contract. You also agree to: (a) provide true, accurate, current and complete information about yourself as required by GE Appliances and (b) maintain and promptly update such information to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete or GE Appliances has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, GE Appliances has the right to suspend or terminate your subscription and refuse any and all current or future orders. Your SmartOrder subscription may not be transferred or assigned.

  7. MODIFICATIONS TO TERMS/SMARTORDER. GE Appliances reserves the right at any time and from time to time to modify the Terms. In addition, GE Appliances further reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, SmartOrder (or any part thereof) with or without notice. You agree that GE Appliances shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Terms and/or SmartOrder.

  8. RENEWAL AND TERMINATION. Your SmartOrder subscription will remain in effect until you cancel it. Notwithstanding the foregoing, you agree that we may terminate your SmartOrder subscription at any time without notice. Upon such termination, you will be billed only for those orders that have been shipped to you.

  10. LIMITATION OF LIABILITY. IN ADDITION TO THE OTHER LIMITATIONS AND EXCLUSIONS CONTAINED IN THE TOU, YOU EXPRESSLY UNDERSTAND AND AGREE THAT GE APPLIANCES SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF GE APPLIANCE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM YOUR SMARTORDER SUBSCRIPTION. OUR TOTAL LIABILITY FOR YOUR SMARTORDER SUBSCRIPTION, WHETHER IN TORT, CONTRACT, WARRANTY, EQUITY OR OTHERWISE WILL NOT EXCEED THE AMOUNT OF ALL PAYMENTS MADE BY YOU DURING YOUR SMARTORDER SUBSCRIPTION.

  11. EXCLUSIONS AND LIMITATIONS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS OF SECTION 10 MAY NOT APPLY TO YOU.
